At times, a court may issue an order requiring an email provider to produce account records. This can happen no matter what email provider you use.

What does that mean?
If we receive a court order asking us to produce the contents of your account, we will take steps other email providers won’t.
Let’s say we receive a court order requiring us to produce records for your account:
If the order requiring us to produce records for your account does not preclude us from notifying you about the court order, we will notify you.
If the order does preclude us from notifying you about the court order, we will file an application with the court to be able to notify you.
On the application to the court, we will need to show the court that you’re using your Hushmail account as part of providing legal services. To do so, we’ll produce:
- Agreement for Law Firms in Respect of Notifications & Privilege
- Documentation provided by you (the lawyer/attorney) evidencing your entitlement to engage in the practice of law (i.e., your licenses and permits)
If we can send notice, you’ll have a chance to argue your Hushmail account is privileged and that its contents shouldn’t be disclosed. This is in your interest — because avoiding disclosure to begin with is better than arguing the information is inadmissible after the other party has already seen it.

Let’s say we receive a court order requiring us to produce contents of your Hushmail for Law account. Depending on how the court order is worded, we’ll either notify you about it right away or file an application that would allow us to notify you. Our ability to notify you is important because it gives you the opportunity to make submissions to the court that your account is privileged and that the contents should not be disclosed. That way, there’s a good chance the court will say yes to a review to first determine what’s privileged and what isn’t — before any emails are disclosed. This process is much better than having your account contents in their entirety handed over at the outset and having to argue later that certain emails shouldn’t be used in court because they’re privileged.
